In accordance with article 22 of law n° 78-17 of 6 January 1978 on computers, files and liberties as modified by law n° 2004-801 of 6 August 2004, the automatic handling of personal data on the website www.magellan-network.com has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL),  declaration number 825985.

In accordance with article 32 of the law number 78-17 of 6 January 1978 relative to computers, files and liberties as modified by the law n° 2004-801 of 6 August 2004, you are hereby informed:

You have a right to access, correct, suppress or stop the use of your personal data, (articles 38 through 40 of the law number 78-17 of 6 January 1978 on computers, files and liberties as modified by law number 2004-801 of 6 August 2004).  To do so, please write to MAGELLAN NETWORK, Data Processing Manager, 85 Bd. Membership in MAGELLAN NETWORK includes access to Magellan’s website.  MAGELLAN NETWORK does not collect information on companies or Service Providers or their representatives unless the organization is a Member of the MAGELLAN NETWORK.  The parties freely and knowingly give this information.  This information allows the MAGELLAN NETWORK to know better its Members, Members to interact among themselves, and to improve the services offered, while assuring the security of the website.  No nominative information is collected on website Users who are not Members of the MAGELLAN NETWORK or contributors.

MAGELLAN NETWORK Members are assigned identification and confidential codes to access the Member restricted areas of the website.  These codes are both personal and confidential.  Members are required to keep all identification data and codes confidential.  Each Member is fully liable for any misuse done using the Member’s access codes.

Unless there is an objection on the part of the Member, the MAGELLAN NETWORK may display the Member’s professional information in the restricted access area of the website which is exclusive, and display their company name in the public portion of the website.

Users are informed that while visiting the website, a cookie may automatically be installed on their navigation software.
 
A cookie is a small piece of data that can be sent by a web server to your computer, which then may be stored by your browser on your computer’s hard drive.

The MAGELLAN NETWORK, in managing a discussion forum, is required to conserve for one year from the date of registration, the following information :

  • The Member’s identity.
  • The computers identification information.
  • Technical characteristics such as the date, the hour and the length of time for each communication.
  • Information on complementary services used or asked for and their suppliers.
  • The information necessary to identify the addressee(s) of a communication.
  • Members of the website www.magellan-network.com are required to respect the provisions of law n° 78-17 of 6 January 1978 on computers, files and liberties.  Violations of this law may result in criminal sanctions.

 

3. Intellectual Property Rights

MAGELLAN NETWORK provides information and an exchange network for the personal use of its Members in the field of international human resources and international mobility.  Said elements are the protected property of the MAGELLAN NETWORK or of third parties who have authorized MAGELLAN NETWORK to use the materials.

All reproductions, representations, use, adoptions, modifications, incorporations, translations, commercialization, whether partial or entire, of any elements of this site, without prior written authorization are forbidden.  Similarly, commercial or other use, even partial, of data that is presented on the website requires prior written authorization from MAGELLAN NETWORK.

With prior notice to the Webmaster, hypertext links can be created to Magellan’s website.

The MAGELLAN NETWORK inform the Members of this website that:

All acts of reproduction and representation, whether total or partial, of the website www.magellan-network.com, without express authorization of Magellan, is likely to be suppressed as a tort of counterfeiting by the articles L.335-2 through L.335-4 of the Code of Intellectual Property.  The punishment for such offense is three years of imprisonment and a 300 000 euro fine.

The trademarks and logos of the website www.magellan-network.com as well as its partners are registered at the Institut National de la Propriété Industrielle (INPI) .   Articles L.713-2 and L.713-3 of the Intellectual Property Code prohibit any act of reproduction, use, or copying these trademarks or logos, without express authorization. Violators of these provisions will engage the liability of the author under L.716-1 of the Intellectual Property Code.  Violation of the Code is punishable by three years of imprisonment and a 300 000 euro fine (article L.716-10 of the Intellectual Property Code.)

Extraction or reuse of substantial parts, both qualitatively and quantitatively, of the data available on this website, can be punished by three years of imprisonment and a 300 000 euro fine, article L.343-1 of the Intellectual Property Code.

The information contained in this website does not create a contract between the MAGELLAN NETWORK and the Member.

MAGELLAN NETWORK verifies all the sections of the website, in particular the section(s) where the Members have the possibility to discuss among each other.  MAGELLAN NETWORK reserves the right to intervene in a dialogue, or remove questions and responses which violate the policy and ethical standards of the MAGELLAN NETWORK, or which contain words or information that are legally reprehensible.  At any time, you can have your contributions to a discussion removed by writing to: MAGELLAN NETWORK, 85 Bd. MAGELLAN NETWORK publishes for informational purposes practical, methodological descriptions of countries.  All of the texts published by Magellan, regardless of the author or program activities, are published without any guarantee of the currency, the exactitude, or the truth.  Each reader is responsible for determining the pertinence of the material.  The MAGELLAN NETWORK declines all liability for these elements.

5. Accredited Services

As a professional organization, the MAGELLAN NETWORK has a role of intermediary between the Members and the Service Providers, by allowing Members to be directly informed of products, or services by external Service Providers who have been accredited to participate in Magellan events either as a Member or a contributor.  In the case where the Member buys products or uses the services of listed or accredited Service Providers, the MAGELLAN NETWORK is under no circumstances liable for any contract or engagement concluded between the Member and a Service Provider especially for the nature, the conformity or quantity of products or the services sold.  All services concerning the sale of products or services are handled directly by the Service Providers.
The MAGELLAN NETWORK is in no case liable for any contract occurring between Members and Service Providers.


6. Acceptation

Member’s use of this website constitutes Member’s acceptance of this Web Policies & Guidelines agreement and Member’s consent to the practices it describes.


7. Law Applicable and Competent Jurisdiction

All disputes or violations arising out of this Web Policies & Guidelines agreement, its execution or its interpretation will be subject exclusively to French law and French tribunals.
